 29.7.2000 SecurityEC concerned about Data Privacy but adopted Plan with US
The European Commission announced that it has formally settled on the so-called Safe Harbor data protection arrangement that allows US companies to engage in e-commerce data transfers with companies and individuals in the European Union (EU), despite European Parliament concerns about the effectiveness of the arrangement.

La comission Européene a annoncé sa prise de position sur l'accord portant sur la protection des données, appelé "Safe Harbor", qui permet aux entrprises US d'effectuer des transferts de données électroniques avec des entreprises et des individus de l'Union Européene, malgrés les inquiétudes du parlement européen sur l'efficacité de cet arrangement.

The Safe Harbor will become effective in 90 days.

If the Safe Harbor appears to be inadequate at protecting EU citizens' personal data, parliament reserves the right to ask the EC to reopen the details of the agreement with the US Commerce Department.

The EC in a statement today said that it also adopted similar decisions for non-EU members Switzerland and Hungary, which it said have adequate data privacy laws on the books.

The Safe Harbor is a voluntary program, under which US companies would adhere to certain data protection "principles," but would still encourage the traditional US industry approach of self-regulation. The Federal Trade Commission (FTC) would provide enforcement backup in the US government for privacy violations.

Si cette accord s'avert inadapté pour protèger les données personnels des citoyens de l'Union Européene, le parlement se réserve le droit de revoir cet accord. Des décisions similaires  ont aussi été adoptées avec la Suisse et la Hongrie.

Cet accord est un programme vcolontaire par lequel les entreprises adhèrent à certains "principes" de protection des données. 

Il devrait être possible de voir quelle entreprise adhèrent à ces "principes" sur une liste publique publiée le département du commerce US.

 

 

 

The EC also said that EU data exporters will be able to see which companies adhere to the arrangement by checking on a public list published by the Commerce Department.
